The Toornament API is developed and owned by the company Toornament SAS.
Toornament API Requirements
By accessing and/or using our Toornament application programming interfaces (the “Toornament API”), you agree to comply with the terms below (the “Terms”) and to comply with our Toornament terms of use, available on https://developer.toornament.com/terms-guidelines. If you do not agree with any of these Terms, you shall not be able to use the Toornament API. We reserve the right to change these Terms at any moment, without notice and you agree to review the Terms periodically to check the changes.
The Toornament API is solely accessible to registered users in order to extend the services provided by Toornament through their registered application, which is identified via a unique Toornament API Key.
Licensed Uses and Restrictions
The Toornament API is licensed to you on a worldwide, limited, non-exclusive, non-sublicensable, non-transferable basis to access and use the Toornament API for a non-commercial use according to the terms set forth below.
Don’t build what we build
You are not authorized to replicate or to attempt to replace the essential user experience of Toornament.com or the other Toornament applications.
Don’t adversely impact our servers
You shall not use the Toornament API in a manner that disrupts or that adversely impacts the servers providing the Toornament API or the other applications using the Toornament API.
Don’t use undocumented endpoints
The use of the Toornament API is strictly reserved to endpoints that are all listed under the Toornament API documentation. You shall not use any endpoint not listed in the Toornament API documentation without our prior approval.
Don’t share your Toornament API Key
Your Toornament API Key is strictly confidential and you are not allowed to share it with any third party.
Don’t spam Toornament users
You shall not use the Toornament API for unsolicited marketing communications.
Don’t make any Violation of Law
You shall comply with all applicable law, regulation, and third party rights. You agree to not use the Toornament API in any manner or for any purposes that may constitute a violation or a breach of any applicable law or regulation, or any rights of any person, including but not limited to rights of privacy, copyrights, or rights of personality.
Termination
We reserve the right to terminate or suspend your license, including your application and your Toornament API Key at any time, for any reason, without notice, especially if you violate any of these Terms.
Disclaimer of Warranties
Unless stated otherwise in a business agreement, the Toornament API is provided on an “as is”, “as available” basis, without warranties of any kind, express or implied, and Toornament SAS, its officers, directors, employees, agents and suppliers disclaim (i) any and all warranties or conditions, including, without limitation, any implied warranty of merchantability, fitness for a particular purpose and (ii) make no warranty that the Toornament API or its services, including but not limited to its website, its data, will be uninterrupted, error-free, secure or that any defects will be corrected. We do not warrant that the data collected through the Toornament API is accurate, complete, reliable, or that it is provided without bugs, errors and/or inaccuracies. You acknowledge that your use of the Toornament API is at your own discretion and risk and you agree that you are solely responsible for any damage that results from your use of the Toornament API, including, but not limited to, any damage to your computer system or loss of data.
Limitation of Liability
Unless stated otherwise in a business agreement, in no event Toornament SAS shall not be liable to you for any damages, including but not limited to, direct, indirect, consequential, incidental, special or punitive damages that may arise from your use of the Toornament API.
To the maximum extent permitted by law, the total liability of Toornament SAS, and its suppliers, for any claim under the terms, including for any implied warranties, is limited to the amount that you paid us to use the applicable API during the twelve months prior to the event that arose the liability.
Limited Relationship
Notwithstanding any other provision of these Terms, nothing in these Terms shall be interpreted as constituting joint entity, agency relationship, joint venture or partnership or any relationship of an employer and employee.
Choice of Law & Disputes
These Terms shall be governed by the law of France and shall be subject within the jurisdiction of the courts located in Paris, France. You agree to exclusively submit to the personal jurisdiction and venue in the courts and tribunals located within Paris, France. In the case that any provision of these Terms is found, by a court of competent jurisdiction, to be illegal, invalid, or unenforceable, the remaining provision shall still apply.
